Intracommunity VAT number: FR05809295959. The Company provides a touring vehicle service with driver operating exclusively on reservation, immediate or in advance.
These General Conditions constitute the contract by which the company proposes and insures the Service and applies for the orders of vehicles passed by the customer to the company by telephone, via Internet via the site https://www.classncourses.fr.
By using the service, the customer acknowledges and accepts all the terms of these terms and conditions.


The company provides a transport service and makes available to its customers passenger vehicles with driver. It is registered in the register of operators of passenger cars with driver under number EVTC093161949 and subject to the provisions of articles L 231-1 to L231-4 of the Tourism Code and to decree n ° 85-891 of August 16, 1985>

 

1.0 PURPOSE OF THE SERVICE

The customer is informed that all the vehicles proposed are of a unique model (sedan). At the moment, the company is unfortunately not able to offer contact with specific vehicles adapted to people with reduced mobility.
The service is open 24 hours a day, and can only be booked in advance.

 

2.0 RESERVING A VEHICLE

2.1 PRIOR CONDITIONS

The reservation of race via the site is subject to the prior acceptance by the customer of these General Conditions.

2.2 STEPS IN RESERVATION

To reserve, the customer connects to the site by entering his reservation. It informs the different fields relating to the desired route (place of departure, possibly a place of destination, type of car). In the absence of information from the place of departure, the ordering process can not succeed. In case of seizure of a place of destination, the company proposes a price to carry out the journey solicited. The customer is free to accept or not the offer proposed by the company; If it accepts it, it must first have ensured that all the information displayed is in accordance with the desired path.

The company transmits the elements of the Order to the driver responsible for the daily journey.

 

2.3 RESERVATION IN ADVANCE

The customer can reserve a vehicle with the company before the date and time of departure of the race in question. The delay may be from 1 month maximum to at least 30 minutes before the scheduled time of departure.
The customer shall indicate the date, time and place of departure, any intermediate stages and the final arrival point, any other particularities of the race (additional indication for the venue, etc.) and Than the surname and first names of the passenger.
Depending on the number of orders already registered at the chosen date and time, the company reserves the right to refuse additional orders in advance.
The Company records the order and takes into account the search of the vehicle, without making an immediate reservation of a vehicle at the time of the order. Vehicle search is carried out within the hour before the scheduled departure time, depending on the departure location, and traffic conditions.

2.4 RESERVATION AT THE DEPARTURE OF AN AIRPORT

When booking, the customer must specify the airport, the date of the race, and the flight number.
The scheduled time of landing and the arrival terminal, which may be modified by the flight conditions and the airport authority, may be entered but are not contractual.
The company can not be held liable in case of erroneous information indicated by the Customer (incomplete flight number, date error) or in case of incorrect information concerning the reference flight for the race, transmitted by the Service Info of the airport concerned.


2.5 BOOKING BY TELEPHONE

The telephone ordering service is made 24 hours a day, 7 days a week, by means of a call to a "non-surcharged" number (cost of a local call from a fixed telephone).


2.6 RESERVATION BY THE WEB SITE

The customer can place an order online, via the website https://www.classncourses.fr.
The online reservation redirects as soon as validation to a secured site Paypal. No extra charge is levied by the company on the price of the race, except for the extra cost due to the wait time of the passenger by the driver at starting point.

2.7 CLIENT'S OBLIGATION

After validation of the reservation, the customer must arrive at the agreed place on the day and the scheduled time.
The customer will receive an email and / or a sms of confirmation.
In the case of waiting by the driver, a waiting fee, the amount of which is determined in Article 5, will be automatically invoiced to him for more than 15 minutes.
In case of non-presentation of the Client, the Driver is deemed free to leave after a waiting period of 20 minutes.
The customer agrees to behave aboard the vehicle as a good father.
In the event of a degradation of the equipment or vehicle attributable to the Customer, the Company will invoice the Customer for the cost of restoring the vehicle or changing the equipment.
Passengers, adults and children, are required to fasten their seat belts. A fine is incurred by persons who have been detained during a police check.
For safety reasons, it is forbidden to smoke and transport flammable, explosive, corrosive or toxic substances. Failure to comply with this stipulation shall be the responsibility of the Customer and the passenger. The Company reserves the right to make any recourse.
Luggage must be placed in the trunk of the vehicle. The luggage remains under the sole responsibility of the Customer. No baggage can be entrusted to the driver. The driver may refuse baggage of excessive weight or dimensions, as well as those which he considers detrimental to the safety of the transport.
Any modification of the estimate of the race originally planned and to pay in advance via the site (waiting, parking, extra stop, change of address ...) will incur additional costs which are invoiced to the customer directly with the driver.

 

2.8 OBLIGATIONS OF THE COMPANY

The service offered by the company consists of a search service of an available vehicle corresponding to the customer's reservation. The company is thus held to a simple obligation of means and implements all its best efforts in order to find a vehicle available for the Customer as soon as possible.
Upon receipt of the Client's request, in case of seizure of the place of destination, the company undertakes to propose an offer indicating the price of the journey.
If the customer accepts the offer, the company agrees to send him a confirmation of the Order by email and / or sms.

3.0 CANCELLATION OF BOOKING

All cancellation conditions are defined in these Terms and Conditions.
If the vehicle has already arrived at the place of departure at the time of the cancellation, the race will be totally due to the company. If the customer has not canceled the order before the arrival of the vehicle, the passenger does not show up at the place of departure where the driver or the company calls the customer on the telephone, the full value of the ordered race is invoiced to the customer.
 
The customer keeps the possibility to cancel the order 3 hours before the actual time of the start of the race. In this case the full amount of the race will be reimbursed. But in the opposite case he is liable to owe the entire amount of the race to the company.

 

4.0 CONFIDENTIALITY-PROTECTION OF PERSONAL DATA

The present General Conditions are subject to the provisions of the law n ° 78-17 of 6 January 1978 relating to data processing, files and freedoms.
The customer has a right of access, rectification and deletion of the personal data concerning him on simple request addressed to the company.
The company informs the customer about the use that is made of the personal data collected in connection with the use of the site
The company may communicate to third parties the contact details of the customer for the use of the site and in particular the driver. The Client of course has the right to object to the transfer to third parties for the purposes of commercial prospecting of the personally identifiable information held by him (by any means, including simple mail addressed to the company).
The customer accepts that the company reserves the possibility to record and keep, for the purpose of proof, all the information relating to the connections carried out, such as the data relating to the journeys carried out and the personal details of the Client.

5.0 WAITING EXPENSES

The waiting fees are € 0.50 ( Confort range ) and € 1.00 ( Business and Van range ) inclusive of VAT per minute and will have to be paid extra to the driver.

6.0 PAYMENT

The payment can be made directly on the site by means of the secured site Paypal, or directly with the driver by a terminal of bank cards, or cash.

 

7.0 ISSUE OF INVOICE

Once the reservation has been paid online, or by telephone directly from the central office, the company sends an invoice directly to the customer by e-mail to the e-mail address he / she communicated at the time of booking.

8.0 EXECUTION OF THE TRANSIT

8.1 SCOPE OF TRANSFER

The transfer begins at the client's climb in the driver's vehicle and ends at the customer's descent of the same vehicle.


8.2 CUSTOMER SUPPORT

The driver may refuse to take charge of the client.If such a refusal results from the customer's behavior (drunkenness, presence of an animal whose weight exceeds 8 kg and not placed in a cage, danger to the safety of the driver and the vehicle, etc.) or incorrect information Transmitted by the customer.

 

9.0 QUALITY COMMITMENT

9.1 COMPLIANCE WITH REGULATIONS

The company undertakes to ensure that drivers and vehicles comply with the regulations in force concerning the operation of passenger vehicles with drivers.


9.2 INSURANCE

The company is guaranteed by a notoriously solvent insurance company which covers the risks associated with its activity in accordance with the legislation in force.
Passengers are considered as third parties vis-à-vis the driver and are covered for the full amount of bodily injury, tangible and intangible damage they may incur as a result of a traffic accident and for unlimited personal injuries , From the ascent in the Vehicle to the descent, with the exception of damage caused by their fault.

10.0 CLAIM

The client may send a complaint by registered letter with acknowledgment of receipt (LRAR) to the company at the following address: 70 AVENUE JEAN LOLIVE, 93500 Pantin, FRANCE.
Any claim relating to an incident occurring during the race will be transmitted to the Driver, whose company agrees to transmit the exact coordinates at the request of the Customer.

10.1: APPLICABLE LAW AND COMPETENT JURISDICTIONS

These Terms and Conditions are subject to French law.
Disputes between traders will be submitted exclusively to the Commercial Court of Paris.
